1. Acceptance of Terms
By accessing or using NCore Roleplay's services, including our website, game servers, Discord server, and any related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Services.
These Terms constitute a legally binding agreement between you and NCore Roleplay ("we," "us," or "our"). You represent that you are at least 13 years of age and have the legal capacity to enter into these Terms.
2. Account Registration
To access certain features of the Services, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
You are solely responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
We reserve the right to disable any user account at any time in our sole discretion for any or no reason, including if, in our opinion, you have violated any provision of these Terms.
3. User Conduct
You agree not to use the Services to:
- Violate any applicable law, regulation, or third-party rights
- Upload, transmit, or distribute any content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
- Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity
- Interfere with or disrupt the Services or servers or networks connected to the Services
- Attempt to gain unauthorized access to any portion of the Services or any other accounts, computer systems, or networks connected to the Services
- Use any robot, spider, site search/retrieval application, or other automated device, process, or means to access, retrieve, scrape, or index any portion of the Services
- Modify, adapt, or hack the Services or modify another website to falsely imply that it is associated with the Services
- Use the Services for any illegal or unauthorized purpose
4. User Content
You retain ownership of any content you submit, post, or display on or through the Services ("User Content"). By submitting, posting, or displaying User Content on or through the Services, you grant us a worldwide, non-exclusive, royalty-free license to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such User Content in any and all media or distribution methods.
You represent and warrant that: (i) you own the User Content or have the right to use it and grant us the rights and license as provided in these Terms, and (ii) the posting of your User Content on or through the Services does not violate the privacy rights, publicity rights, copyrights, contract rights, or any other rights of any person.
5. Purchases & Payments
We may offer virtual goods, services, or subscriptions for purchase on our website or through third-party platforms. All purchases are final and non-refundable except as expressly provided in our Refund Policy or as required by applicable law.
You agree to pay all fees and applicable taxes incurred by you or anyone using your account. We may change the prices of virtual goods, services, or subscriptions at any time without notice.
All information that you provide in connection with a purchase must be accurate, complete, and current. You represent and warrant that you have the legal right to use any payment method(s) you provide in connection with any purchase.
6. Refund Policy
All purchases are final and non-refundable except in the following circumstances:
- If the purchased item or service is not delivered within 48 hours of purchase and we are unable to resolve the issue
- If the purchased item or service is materially different from what was advertised
- If required by applicable law
Refund requests must be submitted within 7 days of purchase. We reserve the right to deny refund requests that do not meet the above criteria or that we determine, in our sole discretion, are fraudulent or abusive.
7. Intellectual Property
The Services and their original content, features, and functionality are and will remain the exclusive property of NCore Roleplay and its licensors. The Services are protected by copyright, trademark, and other laws of both the United States and foreign countries.
Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
You acknowledge that the Services may contain content owned by third parties, including but not limited to content from Rockstar Games and Take-Two Interactive. Such third-party content is subject to the terms and conditions of those third parties.
8. Disclaimer of Warranties
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT (I) THE SERVICES WILL MEET YOUR SPECIFIC REQUIREMENTS, (II) THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (III) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICES WILL BE ACCURATE OR RELIABLE, OR (IV) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICES WILL MEET YOUR EXPECTATIONS.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE, OUR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, THAT RESULT FROM THE USE OF, OR INABILITY TO USE, THE SERVICES.
UNDER NO CIRCUMSTANCES WILL OUR AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICES EXCEED THE GREATER OF (I) THE AMOUNT YOU HAVE PAID US IN THE PAST SIX MONTHS OR (II) $100.
10. Termination
We may terminate or suspend your access to all or part of the Services, without notice, for any conduct that we, in our sole discretion, believe is in violation of these Terms or is harmful to other users of the Services, us, or third parties, or for any other reason.
Upon termination, your right to use the Services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
11. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms on our website. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms.
If you do not agree to the new Terms, you must stop using the Services.
